Police Attacks Dalit Settlements

In the mid of 28th -29th January 2009 night  at 1:30 am more than 50 police men came in four jeep and two bigger vehicle to the locality of Dharkar locality situated at Hukulganj in Varanasi under police station Cantt. They started to beat the dwellers without giving any warning while they were sleeping. They did not forgive even the women and children. They misbehaved with women. They also tried to rape the women and when they failed in doing so they beat them very brutally. They even did not forgive the old aged women and men.

 

According to one witness victim Vimla in her testimony all the police men were drunken. She also said that the police men threatened them to vacate the place before morning otherwise they will throw bomb over the locality consequences. The police men beat her with lathi at her arms.  She submitted that even the police had not forgiven the pregnant lady who was under eight month pregnancy but the police without seeing or hearing beat her with lathi. She also submitted that the police men were as drunken as they could do any thing.

 

Many person of the locality had got injured on this chaos. They destroyed the house hold articles and bruised the utensils. They did the most atrocities and cruel act and abused very badly.  They also threatened the dwellers with naked revolver and said that if all of you will not vacate the land, we will throw bomb and entire locality will be ruined soon. They had broken the huts of eleven families. In last they threw into fire in the house hold articles of four families.

 

After the incident the dwellers informed the District Magistrates Varanasi through speed post and given by hand an application to Additional District Magistrates and requested to provide them medical treatment and arrange to prepare medico-legal but the administration continuously ignoring their demand and threatening them to keep silent.

 

Shortly it has been published in Kashi Warta a local news paper published in evening that Senior Superintendent of Police (SSP) of Varanasi declared that the Dharkars of Hukulganj belong to Bawaria group and migrant from Bangladesh. It is also published that the SSP got this information from Intelligence agencies so the SSP Varanasi ordered the police to do this act. It seems that high profile people are involved in the matter.

 

Back ground of the case:

Dharkar families have been living at road side for the last four generation. They earn their livelihood by making basket and other article with bamboo. In starting they resides at Nazul land no. 33  but Prakash Singh Patel resident of Bari Bazar, Varanasi had persuaded them to vacate the place so as to construct the boundary to make them safe. All the dwellers accepted and vacated the land no. 33 but after the completion of the boundary Prakash Singh Patel denied to give them possession within boundary and drove them out of land. So the families came at roadside and started to live in the hut.

The dwellers of the place submitted many to administration to provide them safe land so that they may be able to secure their children. In this regard they submitted their application to Additional District Magistrates on 27th January, 2009 to allot them Nazul land no. 33 for residence. The receipt no. 1370 and serial no. of application was 00493. They submitted that they are living endanger at roadside as this is the most crowded road of the city and their children are at the edge of accident. They also submitted that they are living like the most deprived community and they are living in the hut and mud house. They also complained that the police exploit them so that to vacate the place. They further requested the administration to provide the security to their children and family and provide land for residence at Nazul land no. 33.

 

Prior to the above application, on 13th January,2009 they submitted an application to District Magistrates Varanasi to provide them residence under Kanshiram Awas Scheme. The receipt no. 1089 and serial no. of the application is 000212. They submitted that this area is the most affected by traffic due to which there is a constant apprehension of accident. Since they are the poorest section of the society, so they are not capable to build their houses. They also requested to arrange residence under Kanshiram Awas Scheme as the police are making pressure and threatening them to vacate the place, but where they will go along with family.

 

Under section 122 (b)(4)(f) of UP Zamindari Abolition Act, it is clearly mentioned that the Nazul land is allotted to landless schedule caste, but the Prakash Singh Patel has possessed over the land in unauthorized way on the other hand the landless Dharkar community are being deprived from their basic amenities i.e. shelter.

 

In both the application they mentioned that police is exploiting and threatening them, but the administration neither instructed the police nor provided secure and safe place to the community. So in entire episode the role of the administration can not be aspected beyond doubts.

2.Gulab aged about 42 years son of Late Budheram

3.Rajendra aged about 35 years son of Late Kattal

4.Madan aged about 42 years son of Late Kedarnath

1.Gulab son of Late Budheram

2.Ghurelal son of Late Kattal

3.Somaru son of Lallu

4.Vinod son of Lallul

5.Srawan Kumar son of Ghure

6.Matruram son of Lallu

7.Lallu son of Sukhdev

8.Gulab son of Pardeshi

9.Rajendra son of Late Kattal

 

The entire victims are resident of Dharkar locality Hukulganj, Varanasi.

1.Station House Officer of Police Station Cantt

2. Ajay Dubey, Couki in charge of Pandeypur Police Chouki.

3.Prakash Singh Patel resident of Badi Bazar, Varanasi.

 

Plea:

 

Therefore most respectfully it is requested that by looking in the fact and circumstances of the case following plea has been made:

Ensure immediately medico-legal report and provide medical treatment for the injured victim of the Dharkar locality.

Set up an independent enquiry through CBCID or CBI to probe the case as high profile persons are involved in the case and take action against the responsible policemen and Prakash Singh Patel who is hand in glove with police.

Immediately allot Nazul land to the Dharkar community.

Give compensation to the victim of the incident.

Provide such relief as you think fit
